Fine on using banned Torrent sites in India

India has always been a country with free access to torrent sites. In the past, the Department of Telecommunications had issued an order for blocking of websites with illegal and pirated content. Some torrent websites were blocked and were telling users that logging on such type of websites is a criminal offence and carries punishment.

The warning reads, “This URL has been blocked under the instructions of the Competent Government Authority with orders of a Court of competent jurisdiction. Viewing, downloading, exhibiting or duplicating an illegal of the contents under this URL is punishable as an offence under the laws of India under Sections 63, 63-A, 65 and 65-A of the Copyright Act, 1957 which prescribe imprisonment for 3 years and also fine of upto Rs. 3,00,000/-. Any person aggrieved by any such blocking of this URL may contact at urlblock@tatacommunications.com who will, within 48 hours, provide you the details of relevant proceedings under which you can approach the relevant High Court of their grievance.”

The government warning clearly states that viewing, downloading or duplicating copyright content will leave you in violation. For first time offence, you can be booked and it deals in “Offence of infringement of copyright or other rights conferred in the Act” and will lead to an imprisonment term of six months to three years, and a fine of Rs 50,000 – Rs 2 lakh.

Any person who is aggrieved by such a ban can approach High Court. Even while we were using an Airtel broadband, the warning gave us a contact email of Tata Communication to provide details of a wrongful blocking. Websites like Torrenlinks.net, btstorrent.cc, torrentdownloads.me, limetorrents.cc, and more are all flashing this warning.

There is no official word from the Telecom Authority of India or the government on the proxy server or crackdown of Torrents websites and its users.
